These Terms of Use ("Terms") govern your access to and use of omniwears.com (the "Site"), operated by Omniwear ("we," "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
What Omniwear is
Omniwear is a fashion discovery platform. We display product information and, once retailer integrations are live, links to third-party retailers where purchases can be made. Omniwear is not a retailer: we do not sell products, process payments, hold inventory, or fulfill orders. All purchases are made directly with the relevant retailer under that retailer's own terms, prices, and policies.
Preview content
During our launch preview, portions of the catalog shown on the Site are sample listings that demonstrate the product experience and are labeled accordingly. Sample listings are not offers to sell and are not associated with any retailer. As retailer feed integrations go live, sample listings are replaced with live inventory and attributed retailer links.
Product information and pricing
Once live, product details, pricing, and availability are supplied by retailers and affiliate networks and can change without notice. While we work to keep information current, the price and availability shown at the retailer's checkout always control. We are not responsible for discrepancies between information on the Site and on a retailer's site.
Affiliate relationships
We may earn commissions on qualifying purchases made through links on the Site, at no additional cost to you. See our Affiliate Disclosure.
Acceptable use
You agree not to: scrape, harvest, or systematically extract data from the Site; interfere with its operation or security; misrepresent your affiliation with Omniwear; use the Site for unlawful purposes; or copy, frame, or republish substantial portions of the Site's content without permission.
Intellectual property
The Site's design, text, graphics, logos, and software are owned by or licensed to Omniwear and protected by applicable intellectual-property laws. Retailer and brand names, product imagery, and product data displayed via live integrations remain the property of their respective owners and are used under the applicable network or retailer program terms. Nothing on the Site grants you any license to use any trademark displayed on it.
Third-party sites
Links to retailer and other third-party sites are provided for convenience. We do not control and are not responsible for their content, policies, or practices, including order fulfillment, returns, or customer service, which are solely between you and the retailer.
Disclaimers
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or that product information will be accurate or complete.
Limitation of liability
To the fullest extent permitted by law, Omniwear will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site or any transaction with a third-party retailer. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
Indemnification
You agree to indemnify and hold Omniwear harmless from claims arising out of your misuse of the Site or violation of these Terms.
Changes
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Cook County, Illinois.
